An identity thief doesn’t just steal your credit card and personal information to start buying crazily in your name. He gets new cards, opens new loans, and leaves a long trail of unpaid bills in your name. He even uses your identity to commit acts of terrorism or other crimes. What are you to do?

Identity theft occurs more frequently than you would like to believe – and is committed frequently by someone you know. This is what happened to Linda Foley, a magazine writer, who learned that her own employer had swiped her identity to open cell phone and credit card accounts. Now Foley, along with her husband, fight back as the Co-Executive Directors of the Identity Theft Resource Center (ITRC) in San Diego, California.

Can This Happen to You?

After Bridget J. Thomas learned that her identity was stolen by a bank employee at a branch 300 miles from the one she used, she was shocked. And that was just the beginning of her nightmare! When the thief was caught, she was working at a different bank in a different state. After her arrest, collection agencies continued to hound Ms Thomas.

Setting the Record Straight Might Not Be All That Easy – or Quick!

Setting the record straight is the tip of a nightmarish iceberg that can take months – even years to accomplish – often with undue pain and suffering for the victim. In serious cases victims spend an average of 600 hours and $1,400 in out-of-pocket expenses to repair their credit. Until they can prove their innocence, they are more likely to be:

  • charged higher rates for insurance and fees for credit cards,
  • rejected for student loans or home mortgages,
  • arrested for crimes they did not commit.
  • unable to get or keep a job,

A Call From A Collection Agency Or A turndown For A Loan Is Often the Only Tip-off That Your Identity Was Stolen.

A thief needs only one thing to open the doors to his windfall – your Social Security number. Unfortunately it is routinely used by government agencies, health care providers, utility companies, merchants, employers, and financial institutions. Often, your Social Security number is publicly available. That’s how General John M. Shalikashvili, the former Chairman of the Joint Chiefs of Staff, became a victim. His Social Security number and those of many other military officers were published in the “Congressional Record” and were later posted on the internet. Thieves used their identities to open 273 new credit cards accounts and run up a bill of over $200,000.00 in charges.

Develop a Form of Defense

To stop identity thieves in their steps, there are several things you can do. You can begin by freezing access to your credit file. By doing so, you cause your file to become off-limits to anyone who does not know the secret PIN (Personal Information Number) of your choosing. This sets the wheels in motion to protect you from the bad guys – anyone who attempts to apply for credit in your name. It causes their application to be rejected; although your credit cards won’t be affected. And if you want to apply for new credit or let a bank, store, or agency run a background check on you, you can get a credit thaw. For example, if you decided to shop for a big-ticket item, like a car, you might thaw your history for auto dealers.

Other Things You Can Do – Starting NOW!

  • Periodically check your credit report for suspicious activities. Americans are now entitled to a free annual credit report from each of the three bureaus: Experian, Equifax, and TransUnion.
  • If you elect to shop online, use a credit card rather than a debit card. With a credit card, you have the extra protection of maximum liability of $50.00 for unauthorized purchased.

In the Event You Do Become A Victim

Here are some steps to take:

  • Act fast and prepare yourself for an uphill battle uncooperative and unsupportive credit card and law enforcement agencies. For guidance and support, I suggest that you turn to organizations and agencies like ITRC (www.identitytheftcenter.org), the Federal Trade Commission (www.FTC.gov), and others. All can be found at http://www.ProtectingYourIdentity.blogspot.com/.
  • Call the fraud dept. of one of the three credit bureaus, Experian, Equifax, and TransUnion, and request that a fraud alert be placed on your credit reports. (The other two credit bureaus will automatically be notified.) The alert lasts for 90 days and requires creditors to call you before opening new accounts in your name; however, a word of caution is in order here. There are no legal requirements to honor alerts and merchants who are eager to make a sale may ignore them.
  • Close your credit card accounts and change the passwords on all your financial and banking accounts.
  • File a police report. Although credit bureaus won’t extend a fraud alert without it, be aware that local police departments may be reluctant to provide a report. Many may lack the resources to properly investigate the crime.
  • Mail copies of the police report to all three credit bureaus with a cover letter demanding your complete credit file.
  • Call every credit where you know a bogus account has been created and have them close your file immediately. Demand copies of all fraudulent applications for credit and billing statements. Creditors don’t want to divulge that information, but they will if you enclose a copy of a police report and forward your request it in writing via certified mail.

Conclusion:

Face it, identity theft is a growing problem affecting everyone in some way or another. With the increase popularity of internet usage, it has become easier for cybercriminals to steal our identity. In 2002 alone, the victim total due to identity theft climbed to 10 million, a new high. The cost to the economy was up an astonishing 41 percent to $52.6 billion, according to The Identity Theft Survey Report, available from the Federal Trade Commission at the website (www.consumer.gov/idtheft/). Each year these totals are climbing with no apparent sign of slowing down.

Avoiding the Creative Crimes of the Century

Criminals are increasingly creative in the methods by which they steal your identity, your money, and your life. They are usually several steps ahead of the average consumer. With how many of the following “creative” schemes are you familiar:

  • “Dumpster-diving”
  • “Mail theft”
  • “Pharming”
  • “Phishing”
  • “Skimming”
  • “Shoulder-surfing”

One of the positive things criminals have done, if I may say so, is add “creative” terms to our vocabulary. It always amazes me how intelligent and creative criminals can be! – Always one step ahead of their next victim, and ultimately, the law!

Whether they go after your mail, or go “dumpster-diving”, or go “shoulder surfing”, or “pharming”, the end results are always the same: They become successful over another innocent victim!

Identity criminals are basically lazy people, in my opinion. Rather than getting a legitimate job, they would rather come up with “creative” schemes to part their victims from their personal information and their money.

One of the laziest ways they steal our identity, usually with our unwitting help, is through “Dumpster-diving”. They simply sort through a person’s trash for paper records such as credit card offers, bank statements, past paid bills, or anything that has your personal and financial information. Sometimes they can obtain a full profile of us from separate documents (such as church records, car repair reords, personal letters, medical reords, etc.) they find. And businesses as well as consumers fall victim to this one form of theft.

Mail theft is a low-tech method lazy criminals use to go after your personal and financial information. As with “dumpster- diving”, it another easy way for criminals to get what they want with hardly any effort on their part, thanks to our unwitting help. For example, we leave a red falg on our mailbox to alert the mail carrier that there is out-going mail to be picked up. Or the mail carrier might do likewise to alert us to pick up our mail. Unfortunately, criminals love this because they tells them that the mailbox is ripe for the picking. A friend of mines calls this “The Low-Handing Fruit Scheme”.

“Shoulder-surfing” is a low-tech, low-touch technique criminals use to get your information – and they boldly do so in public places usually right under our noses or over our shoulders. Typically they would watch or listen carefully as we key our credit card number or password into a keypad, or give the our account number over the telephone. And don’t for a moment think that they have to be standing within earshot to steal your info. No!

Sophisticated shoulder surfers have been known to use bioculars, telescpes, or super-sensitive listening devices to steal your info from across the room or across the street. Sometimes they will record the sounds for accurate playback. Recording of the keypad sounds help them analyze those tones for replicated PIN numbers and passwords. Some criminals standing nearby may even use their camera-cellphone to record the numbers they see or take a picture over your shoulder.

“Pharming” comes in several version. I’ll just discuss one here. Similar to “Phishing”, “Pharming” is an electronic scam in which criminals attempt to steal personal and financial information from numerous people simultaneously through something known as “Domain Spooling”. Here the hackers take over a DNS server and redirect user information to a new website that they use to gather illegal information.

“Phishing” also bears mentioning here. It is a scam in which you, the consumer, are tricked into entering your personal and financial information (account numbers, Social Scurity number, PIN number, password, etc.) via a bogus email and website form. The email looks as if it was sent from a company with whom most consumers may have an affiliation, such as AOL, PayPal, eBay, or a major bank or credit card company; but, in reality, are nothing more than identity theives hiding behind the email.

“Skimming” is a another growing identity theft scam where criminals quickly and temporarily steal a credit card and run it through a credit card reader known as a skimmer that has been reprogrammed to steal information off the card. Often, this takes place at a hectic retail store where a consumer might not notice that their credit card has been taken from them for a few moments.

And the list goes on. I’m sure that by the time you read this, there will be several new types to describe new and creative way these cybercriminals have come up with to part you from your personal information and your money. 14 Steps You Can Take to Prevent Identity Theft:

The Fair and Accurate Credit Transaction Act, known commonly as FACTA, was put into law in the United States to help to protect consumers from identity theft and to help in its prevention. FACTA ensures that all citizens are treated fairly when they apply for a mortgage or other form of credit and it entitles them to a free annual credit report to verify its accuracy.

Becoming a major epidemic, Identity Theft occurs when a criminal uses another person’s personal information to take on that person’s identity. Identity theft includes the misuse of a Social Security number, credit cards, mail fraud, scam, schemes, frauds, or any other form of misuse or abuse of a victim’s identity.

There is no guarantee that you will never be a victim; however, there are steps you can take to minimize your risk. Here is a list of 14 steps you can take to prevent or at least minimize its occurrence:

1. Manage your personal information cautiously and with a new awareness that identity theft can occur anytime anywhere and when you least expect it.

2. Ask about security procedures in your workplace, doctor’s office, or other business or organization that routinely collects relevant and personal identifying information as part of doing business or providing a service. Find out who has access to your personal information and verify that it is handled securely. Inquire about their disposal procedures and if your information will be shared with anyone else (namely third parties such as mailing list companies, marketing and survey companies, etc.).

3. Instead of giving your Social Security Number, inquire if you can use other types of identification. Use your Social Security Number with caution and only when absolutely necessary.

“Your Chances of becoming victimized by some form of identity theft is one in ten,” according to the Federal Trade Commission.

4. If you find that you have been victimized, immediately file a complaint with the Federal Trade Commission. The FTC maintains a database of identity theft cases used by law enforcement agencies for investigations. Filing a complaint helps the FTC learn more about identity theft and the problems victims are having. This knowledge helps them to assist you better.

5. Carry only the identification and the number of credit and debit cards that you will actually use. Leave extra cards in a safe place at home, in a safety deposit box, or any other secured location.

6. Avoid giving out personal information on the phone, through the mail, or on the internet unless you are absolutely sure you know and can trust with whom you are communicating. Caution: Before you share personal information, be sure you are dealing with a legitimate business or organization. (If you are unsure about an online communication, check the organization’s website by typing its URL in the address line. Most large companies post alerts on their sites when they are aware of a scam when their name is used improperly.)

Identity thieves usually pose as representatives of banks, lotteries, sweepstakes, internet service providers, or some other officially-sounding-entity. They will use any means possible to try to get you to reveal your valuable information.

7. Call the Customer Service Department of companies or organizations with whom you do business using the number listed on your account statement or in the telephone book.

8. Do not place passwords on your credit card, bank, or telephone accounts.

9. When choosing a password, avoid using obvious information like your mother’s maiden name, your birth date, a series of consecutive numbers, or the last four digits of your Social Security Number or your phone number.

10. Pay attention to your billing cycles. A missing bill could mean an identity thief has gotten their hands on it.

“9.9 million people were victims of identity theft in 2002″, according to the Federal Trade Commission. Don’t wait until it happens to you.

11. Be wary of promotional scams or phony offers to get you to give them your personal information such as lottery and sweepstakes’ that you have never entered and ones asking for an “administration” fee.

12. If your job requires you to suit up in special clothing at work, never leave your purse or wallet in your personal clothes. Always keep them in a safe and secured place.

13. When reordering checks, pick them up at the bank instead of having them sent to your mailbox.

Pierce the Corporate Veil

The corporate structure of your business will provide shelter for your personal assets. There are several events that will cause a judge to disregard the corporate entity or “pierce the corporate veil.” There are several reasons why the corporate veil may be pierced. There are also several easy steps you can do to avoid the corporate veil from being pierced.

The corporate veil can be pierced if a party is tricked or misled into dealing with the corporation rather than an individual. Whenever the corporation does correspondence with a third party, the officers and directors of that company need to make it clear that they are acting on behalf of the corporation and not themselves individually. All the documents need to clearly be entered into on behalf of the corporation otherwise there may be a conflict that could arise that would pierce the corporate veil.

If the corporation is set up to never make a profit or always be insolvent it is considered too “thinly” capitalized. This could be when the corporation is formed without sufficient capital to meet potential liabilities and debts. This often occurs when an individual or group of people uses a corporation as a form of shield from liabilities instead of a legitimate business.

When the corporation fails to follow corporate formalities where the corporation is located, it can be pierced. A few of the corporate formalities are meetings, minutes, stock ledger. If the corporate entity fails to do some of these duties the judge can rule that it is not a proper corporation.

The biggest mistake small corporations usually make is not keeping separate accounts for the corporation. If an individual moves funds from their bank account into the corporate bank account, and vise versa then the court will disregard the corporate entity.

If the corporation is engaged in illegal enterprise where it is ruled that the corporation was setup as a sole means for those involved to partake in an illegal activity, the corporate veil can be pierced. For instance, a corporation will not be tried for murder. The individuals responsible will be tried for it. The same thing can be applied for all kinds of cases such as drug trafficking, etc.

While it is possible for the corporate veil to be pierced, if you take the proper precautions when setting up your corporation you will help to protect your own personal assets. A few of the steps to protecting your personal assets are quite simple and some are even common sense. The important thing is that you take care when operating a business, and you get sound legal advice before doing anything questionable.

Identity Theft – the 10 Best Tips You Can Use Right Now!

We’ve all heard horror stories about fraud that’s committed by someone stealing a name, address, Social Security number or credit card. Here are 10 suggestions you can take to help protect yourself.

1. The next time you order checks, have only your initials (instead of your first name) and last name put on them. If someone takes your checkbook, they won’t know if you sign your checks with just your initials or your first name, but your bank will know how you sign your checks.

2. When you are writing checks to pay your credit card accounts, DO NOT put the complete account number on the “For” line. Instead, just put the last four numbers. The credit card company knows the rest of the number, and anyone who might be handling your check as it passes through all the check processing channels won’t have access to it.

3. Put your work phone number on your checks instead of your home phone. If you have a PO Box, use that instead of your home address. If you don’t have a PO Box, use your work address.

4. Never have your Social Security number or driver’s license number printed on your checks. You can add it if it is necessary. But if you have it printed, anyone can get it.

5. Place the contents of your wallet on a photocopy machine. Do both sides of each license, credit card, etc. You will know what you had in your wallet and all of the account numbers and phone numbers to call and cancel. Keep the photocopy in a safe place. It’s also a good idea to carry a photocopy of your passport when traveling abroad.

6. For couples or friends traveling together – each of you should carry a different, unique credit card. For example, one of you could carry a Visa card and one of you a Discover card. Don’t both carry the same credit card! That way if one of you has their credit card stolen, you still have a valid credit card to use and aren’t completely without funds while you are traveling.

7. Another tip for couples or friends traveling together – each of you should carry the other person’s photo copies of their credit cards and passport. If someone steals your wallet or purse, your traveling companion still has copies of all your information.

8. When you’re reading email, don’t click on any of the links listed in the email message. No matter how tempting the offer is! This is a way ‘phishers’ use to direct you to their website and capture your credit card and personal information.

9. We are told to cancel our credit cards immediately. But the key is having the toll free numbers and your card numbers handy so you know whom to call. Keep these numbers where you can find them separate from your credit cards.

10. File a police report immediately in the city where your credit cards, purse or wallet were stolen. This proves to credit providers you were diligent, and this is a first step toward an investigation.

This one should really alert people. The reason ? Everybody now knows somebody who’s been victimized. That alone tells you what an epidemic identity theft has become. Why should you worry about identify theft? For one thing, a seriously damaged credit report can ruin your chances of getting a new job, a bank loan, insurance, and even rental housing. In the worst case scenario you could even be arrested if someone utilized your identity to commit a crime.

Here are some tips to help reduce the chances of having your identity compromised:

1. When making a credit card purchase, blank out the 12 numbers of your credit card number on the printed receipt (assuming that all 16 are printed as some places still do). This holds especially true at restaurants. Try not leaving the signed receipt left on the table with all numbers visible. You are permitted by law to mark out 12 of them so that passerby’s can’t get a glance and memorize your credit card number.

2. Avoid relaying your social security number to anyone unless it’s absolutely required. Use common sense in most cases, for example to open a bank account you will probably need to give out your social security number, but if a store clerk simply wants to use your social security number to use as an ID, then you should reserve from doing so in most cases.

3. Have access to a personal shredder. For any documents you plan on throwing away it helps to shred anything that contains personally identifiable information including social security, credit card numbers, phone numbers, and birth date.

4. In the worst case scenario, i.e. if your identify has been stolen, here are some steps to assuage the situation: Contact your credit card companies and have them close your accounts as well as issue new cards for you. Put a fraud alert via one the three major credit bureaus. One will notify the other two automatically. File a police report to use as evidence when creditors ask for it. File a notice or complaint with the Federal Trade Commission, which manages a database of identity theft related cases which are used by law enforcement personnel for their investigations.

Try to use your intuition in most cases. The most reported incidents of identity theft generally are not necessarily the most technologically sophisticated.

How Turn A Franchise Agreement To Your Advantage

Deciding to buy a Franchise is a huge decision. Once you have convinced yourself that franchising suits your character and business aspirations, have identified the right franchise, done your sums, attended the initial training and perhaps paid an initial deposit you will be presented with a Franchise Agreement to sign.

Typically this agreement could run to 40 or 50 pages and can be a daunting read to those unfamiliar with commercial contracts. The very nature of a franchise business structure means that the agreement will be fairly complex. Remember that this document provides the framework for your business life over the next seven years or so.

Franchisors, particularly established ones, will rarely change or negotiate the terms of their standard Franchise Agreement as they will want to maintain uniformity across all the franchises. However, it is essential that you understand what you are being asked to sign. Once you have signed an agreement as a business person (without the cotton wool treatment given to consumers) you will struggle to persuade a court later that the terms were unfair or sufficiently unreasonable to be void. You will be stuck with it! I strongly recommend that you seek legal advice from a commercial solicitor familiar with franchising.

Key areas include establishing the true cost of the franchise including ongoing royalties, advertising costs, minimum stock purchases. What location and territorial rights have been granted? Are these exclusive to you? What property and equipment is required? What obligations are there on you and the Franchisor relating to the ongoing operation of the franchise?

Often the most complex area relates to renewal and termination of the franchise. Are you granted an automatic renewal right beyond the franchise term of 5 or 7 years? What renewal fee is payable? Can you sell the franchise on? Usually you will need to give the franchisor first option and/or a right of veto over the acceptability of any proposed transferee, often coupled with a % fee. What are the consequences of an early termination by you if you want or need to get out prematurely? There will usually be a minimum period with forfeiture of the franchise fee, stock and possibly other financial penalties and compensation. What if you are in breach? What circumstances would lead to an automatic termination? Are you given a period in which to remedy your breach?

Ask yourself some “What if?” scenarios. What if you died or were seriously ill? What if you failed to meet your sales targets? What if you wanted to sell product out of your territory? What if a customer sued you for faulty products? If you cannot answer all your What ifs, do seek more advice. Don’t be afraid to ask the Franchisor these questions. But don’t expect an impartial response. The Franchise Agreement will usually have an express term preventing any reliance upon representations or claims made by the Franchisor in the initial presentations or documentation. Much to the disappointment of many clients who come to us for advice having run an unsuccessful franchise, this applies particularly to any claims as to how much money can be earnt… Buyer beware!

Fake items abound on eBay, and it takes much effort not to be duped by scammers who peddle these wares. There have been many painful stories relating how a seemingly legitimate item turned out to be either fake or defective.

It is possible, however, to avoid these scams if one is careful and vigilant. Buyers should be wary of any purchase over eBay, and should take steps to ensure the authenticity of the item and to make sure the item is in reasonable condition.

Be Vigilant
Buyers should take the initiative by doing plenty of background research. They must learn as much as possible about the products before bidding on them. If the seller provides pictures of an item, they should not be taken at face value. Comparison of these pictures with the real item helps in this regard.

Many sellers will use pictures from manufacturers that do not represent the item they are actually selling; buyers should ask the seller for actual pictures of the item. If the seller balks, buyers should refrain from bidding. Collector’s items, autographed memorabilia, and historical artifacts are common items that are misrepresented on eBay.

Authenticate
Familiarize yourself with the various bodies that certify respective items. For example, reputable merchants of autographed sports memorabilia should include a COA (certificate of authenticity) from a trusted third party. Counterfeit or misrepresented items should be reported to eBay. When buying on eBay Motors, one may have an inspection service double-check if the seller is accurately representing his automobile.

Look at the Feedback
One should analyze the feedback rating of a seller. Analyzing feedback is another helpful exercise to prevent scams. Sellers who have an established history of credible sales are usually helpful and professional to deal with. Negative feedback should be a red flag as to whether one should pursue a trade with the person. The same thing applies for those who do not have feedback ratings at all.

Buyers must be careful however, since it is possible that a scammer has hijacked an account that has positive feedback.

Buyers should make sure they have read the entire product description on its eBay listing. Things to look out for are disclaimers, damages, current item condition, years of use, and others. If this information is not specified, it would do well for the buyer to contact the seller regarding such.

The Price Theory
If the price for an item is too good to be true, it probably is. Auctions that carry outrageously low prices should be taken skeptically.
